The Equus Hotel ("The Equus," "we," "us," or "our") respects your privacy. This Privacy Policy explains what personal information we collect, how we use and share it, and the choices and rights available to you.

This policy applies to information we collect through our website at equushotel.com, through our online booking engine, by telephone, by email, in person at the hotel and at Paniolo Bar & Café, and through our marketing and social media activities.

1. Information We Collect

Information you provide to us

We collect personal information you give us directly, including when you make or modify a reservation, check in or out, contact us, join a mailing list, enter a promotion, book an event or wedding, apply for employment, or make a purchase at the hotel or at Paniolo Bar & Café. This may include:

  • Name, postal address, email address, and telephone number
  • Reservation details, including arrival and departure dates, room type, rate, number of guests, and length of stay
  • Payment card information and billing details
  • Government-issued identification when required at check-in
  • Preferences, special requests, accessibility needs, and dietary requirements
  • Loyalty, membership, kamaʻāina, military, government, or corporate rate eligibility information
  • Communications you send us, including email, text messages, reviews, and survey responses
  • Information about other guests in your party that you provide when booking on their behalf

If you provide information about another person, you confirm that you have their permission to do so and to have us handle their information as described in this policy.

Information collected automatically

When you visit our website or interact with our digital properties, we and our service providers automatically collect certain information, including:

  • Operate, improve, and secure our website and booking systems
  • Understand how guests find and use our website, and measure the performance of our marketing
  • Deliver and measure advertising, including the audience matching described in Section 4

  • Establish, exercise, or defend legal claims

3. Cookies and Similar Technologies

We use cookies, pixels, tags, software development kits, and similar technologies on our website and in our email communications. These technologies fall into the following categories:

  • Strictly necessary. Required for the website and booking engine to function, including session management and security.
  • Functional. Remember your preferences, such as language and currency.
  • Analytics. Help us understand how visitors use our website so we can improve it. We use Google Analytics for this purpose.
  • Advertising. Allow us and our advertising partners to show you relevant advertisements on other websites and platforms, and to measure whether those advertisements led to a booking. These include the Google Ads tag and the Meta Pixel.

The Meta Pixel

Our website uses the Meta Pixel, a tool provided by Meta Platforms, Inc. (Facebook and Instagram). The Meta Pixel collects information about your visit, including pages viewed and actions taken such as starting or completing a booking. This information is transmitted to Meta and may be linked to your Facebook or Instagram account if you have one.

We use the Meta Pixel to measure the results of our advertising, to show advertisements to people who have visited our website, and to build audiences of people with characteristics similar to our guests. Meta acts as our service provider for some of these purposes and as an independent controller for others. Google technologies

Our website uses Google Analytics, Google Ads conversion tracking, and Google Ads remarketing tags. These technologies help us understand website traffic, measure which advertisements lead to bookings, and show advertisements to people who have visited our website. Google may use this information in accordance with its own privacy policy. You can opt out of Google Analytics using the Google Analytics Opt-out Browser Add-on, and you can adjust the advertisements you see through Google Ad Settings.

Managing cookies

Most browsers allow you to refuse or delete cookies through their settings. If you block cookies, some features of our website and booking engine may not work properly. You can also opt out of interest-based advertising from participating companies through the Digital Advertising Alliance at optout.aboutads.info and the Network Advertising Initiative at optout.networkadvertising.org.

Global Privacy Control and Do Not Track

We honor the Global Privacy Control (GPC) signal where required by law. Because there is no common industry standard for interpreting browser Do Not Track signals, our website does not currently respond to them.

4. Advertising, Audience Matching, and Measurement

This section describes how we use your information for advertising. Please read it carefully.

We use information you provide to us directly, including your name, email address, postal address, and telephone number, to deliver relevant advertising and to measure how our advertising performs. This includes information collected when you make a reservation, stay with us, sign up for our communications, or otherwise interact with us, whether through our website, by telephone, or in person at the hotel.

To do this, we share this information with third-party advertising platforms, including Google and Meta, who process it on our behalf. Before we share it, this information is converted into a non-reversible, hashed form. The platforms use it to match against their own records so that we can:

  • Show advertisements about The Equus to people who have stayed with us or expressed interest in staying with us
  • Reach people whose characteristics are similar to those of our past guests
  • Avoid showing advertisements to people who have recently stayed with us
  • Measure how many people who saw our advertisements went on to make a booking

Our service providers are contractually restricted from using this information for any purpose other than providing services to us, and are not permitted to sell it or share it with others for their own purposes.

We do not sell your personal information for money. Certain uses of advertising and analytics technologies described in this policy may be considered a "sale" or "sharing" of personal information for targeted advertising under some state privacy laws. See Section 7 for how to opt out.

To opt out of having your information used for advertising audiences, email reservations@equushotel.com with the subject line "Advertising Opt-Out" and we will remove you from these audiences.

5. How We Share Your Information

We share personal information with:

  • Service providers who perform functions on our behalf, including our booking engine provider, property management system provider, payment processors, email and communications platforms, review and reputation management platforms, website hosting and analytics providers, advertising platforms, and marketing agencies.
  • Booking channels when a reservation is made through an online travel agency, wholesaler, travel agent, or corporate booking platform.
  • Business partners where you have booked a package or promotion involving another business, and only to the extent needed to fulfill it.
  • Professional advisors such as attorneys, accountants, and insurers.
  • Government authorities or other parties where required by law, subpoena, or legal process, or where necessary to protect the rights, property, or safety of The Equus, our guests, or others.
  • A successor entity in connection with a merger, acquisition, financing, reorganization, or sale of assets.

We may also share aggregated or de-identified information that cannot reasonably be used to identify you.

6. Data Retention

We retain personal information for as long as needed for the purposes described in this policy, including to maintain guest history, honor return-guest recognition, meet financial and tax recordkeeping requirements, and resolve disputes. Reservation and guest records are generally retained for at least seven years to satisfy accounting and tax obligations. Marketing audience data is refreshed periodically, and records are removed when they are no longer relevant or when you ask us to remove them.

7. Your Privacy Rights

All guests

Regardless of where you live, you may:

  • Unsubscribe from marketing emails using the link in any message
  • Ask us to correct or update your information
  • Ask us to remove you from our advertising audiences
  • Ask what personal information we hold about you

California residents

Under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, California residents have the right to know what personal information we collect, use, disclose, and share; to request deletion; to request correction; to opt out of the sale or sharing of personal information and of targeted advertising; to limit the use of sensitive personal information; and to not be discriminated against for exercising these rights.

In the preceding twelve months, we have collected the categories of personal information described in Section 1 and disclosed them for the business purposes described in Section 5. We do not knowingly sell the personal information of consumers under 16 years of age.

To exercise these rights, email reservations@equushotel.com or call (808) 949-0061. We will verify your request using information we already hold, such as your email address and reservation details. You may designate an authorized agent to submit a request on your behalf.

Residents of other US states

Residents of states with comprehensive privacy laws, including Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, and others as those laws take effect, have rights to access, correct, delete, and obtain a portable copy of their personal information, and to opt out of targeted advertising and profiling. Use the contact details above to exercise these rights. If we deny your request, you may appeal by replying to our response.

European Economic Area, United Kingdom, and Switzerland

If you are located in these regions, we process your personal information on the following legal bases: performance of a contract (to provide your reservation and stay); legitimate interests (to operate, secure, and improve our business, and to market to existing guests); consent (for certain marketing and non-essential cookies); and legal obligation (for tax and regulatory recordkeeping).

You have the right to access, correct, erase, restrict, and port your personal information, to object to processing based on legitimate interests, to withdraw consent at any time, and to lodge a complaint with your local supervisory authority.

Canada

Canadian residents may access and correct their personal information and withdraw consent to marketing communications, subject to legal and contractual restrictions.

International transfers

The Equus is located in the United States, and personal information we collect is processed and stored in the United States. If you are located outside the United States, your information will be transferred here, where privacy laws may differ from those in your country. Where required, we use appropriate safeguards for these transfers.

8. Security

We use administrative, technical, and physical safeguards designed to protect personal information, including encryption of payment data in transit and access controls on our reservation systems. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we become aware of a breach affecting your personal information, we will notify you as required by Hawaii Revised Statutes Chapter 487N and other applicable law.

9. Children

Our website is not directed to children under 13, and we do not knowingly collect personal information from children under 13 online. Children may of course stay at the hotel as part of a family reservation, and we collect only the information needed for that stay. If you believe a child has provided personal information through our website, contact us and we will delete it.

10. Third-Party Websites and Services

Our website links to other websites and services we do not control, including our booking engine, online travel agencies, review platforms, social media, and the Hawaiʻi Polo Club and trail ride operations. This policy does not apply to those services. We encourage you to review their privacy policies.

11. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above. Material changes will be communicated through a notice on our website. Your continued use of our website or services after a change takes effect constitutes acceptance of the revised policy.
